When Can I Modify an Existing Divorce Order?
We are very familiar with the California family court system and the way that family law matters are handled, including legal modifications. When the parties agree to a modification, the court still has to approve the agreement in a Stipulation and Order, which must be signed by a judge to become a binding court order.
If there is no agreement between the parties, one person can file a Request for Order and ask the court to make a decision on the requested modification. Usually, a change in circumstances is required to modify permanent orders.
Some change in circumstances warranting modifications may include:
- Contemplated or actual relocation
- Severe illness (physical or mental)
- Loss of employment / Change in income
- The occurrence of domestic violence
