Mothers’ Rights Representation in San Jose
Personalized Family Law Counsel for Mothers in Santa Clara County
Mothers often face several family law issues at once, especially when parenting arrangements, financial support, divorce, and safety concerns overlap. Magdalena Law Group advises and represents mothers who need to understand their options and make informed decisions about their families.
Our team represents parents in Santa Clara County court proceedings. California courts hear divorce, legal separation, and parentage matters. They also decide child custody and visitation, child and spousal support, and domestic violence restraining orders.
Speak with our San Jose mothers’ rights attorneys about your circumstances and possible next steps. Call (408) 601-4439 to request a consultation.
What California Courts Consider in Child Custody
California custody law doesn’t presume that a mother or father is the better caretaker. Courts focus on the child’s best interests when deciding legal custody, which concerns major decisions for the child, and physical custody, which determines where the child lives.
Parenting time determines when each parent cares for the child. When parents dispute allegations about caregiving, conduct, or safety, the court considers the available evidence rather than either parent’s status as the mother or father.
Factors that can affect a custody decision include:
- Each parent’s involvement in the child’s life
- Each parent’s ability to provide a safe environment
- Any history of abuse in the home
- Any history of substance abuse
- The child’s preferences, when the court considers them
Santa Clara County Custody & Visitation Procedures
Santa Clara County custody and visitation matters are filed and heard at the Family Justice Center Courthouse. Parents who disagree about these issues must complete Parent Orientation and attend Family Court Services mediation before a contested hearing.
Family Court Services mediation is free, confidential, and non-recommending, which means the mediator doesn’t share notes or recommendations with the judge. A missed appointment, or a cancellation made less than 48 hours beforehand, is subject to a $100 fee.
This required process differs from private mediation or settlement discussions intended to reach an agreement. If court action is necessary, a Request for Order asks the Santa Clara County court to make temporary or permanent decisions about custody, visitation, or support.
Interference with Court Orders & Family Safety
Existing custody and visitation orders remain in effect while parents work through a disagreement. Denying the other parent access in violation of an order can result in civil penalties, criminal penalties, or both. We guide mothers through the appropriate court process for addressing these disputes.
Abuse concerns may affect a custody case because courts consider a history of harmful conduct when evaluating parental fitness and the child’s safety. Restraining-order issues and custody decisions can arise within the same case.
Our representation in parental-rights cases can address child custody, visitation, child support, spousal support, and domestic violence restraining orders. We evaluate how these connected issues should shape the legal strategy.
Representation from Consultation Through Resolution
We begin by discussing the family situation, current orders, disputed issues, and decisions the client needs to make. We offer in-person consultations in San Jose as well as phone or online consultations when schedules or distance make travel difficult. Our multilingual and multicultural team works with clients from varied backgrounds.
Depending on the circumstances, we pursue mediation or negotiated agreements when appropriate. These processes allow parents to participate in shaping proposed terms, while court proceedings place decision-making authority with the judge. When litigation is needed, we provide in-court advocacy.
Our firm is led by Magdalena Chattopadhya, a Board Certified Family Law Specialist through the State Bar of California Board of Legal Specialization and a Board Certified Family Law Trial Advocate through the NBTA. Attorney fees and case costs depend on the services required and the circumstances of the case.
Discuss Your Family Law Options
A consultation allows you to explain the current dispute, identify immediate concerns, and discuss possible legal paths with our attorneys.
Whether the case may be resolved through an agreement or requires court advocacy, we can assess the available process and help you prepare for the decisions ahead.
